Terms of Service

These Terms form the agreement between you and AGORHUB S.R.L. ("we"), identified in Company details, for the use of LiveGexLevels (the "Service"). By creating an account or using the Service you accept them, together with the Risk Disclosure and the Privacy Policy.
1. What LiveGexLevels is
LiveGexLevels provides levels and impersonal market information about the S&P 500, in the application and, where you enable them, through alerts and an API for your own software. The levels are the same for every subscriber and do not take your situation into account.
2. What it is not
It is not investment advice, research or a recommendation to buy, sell or hold anything. We are not an investment firm, bank, broker or adviser and are not authorised by any financial supervisory authority. The Service never places, modifies or cancels an order and never moves money or assets. We receive no commission or inducement from anyone in connection with what you trade.
3. What you confirm
By accepting these Terms you confirm that you have read the Risk Disclosure; that you understand that nothing in the Service is advice and that trading options, futures and 0DTE instruments can lose money quickly, including more than you committed; that you take your own decisions, after checking prices and contract terms with your broker; that you trade only with money whose loss you can bear; and that the information you give us is true. You are not relying on any statement, level, example or illustration of ours as the basis for an investment decision. Nothing in this agreement creates an advisory, fiduciary or agency relationship. Your acceptance is recorded with its date and the version of each document, and we may produce that record as evidence.
4. Eligibility and your account
You must be at least 18, have the capacity to contract, and not be subject to sanctions or resident where the Service is prohibited. Give accurate details, keep your password confidential and tell us at once if you suspect unauthorised access. Accounts are personal: one person, one account, and credentials may not be shared. An e-mail address is a single account across the services we operate.
5. Your licence and its limits
We grant you a personal, non-exclusive, non-transferable and revocable licence to use the levels for your own trading decisions while your plan is active. You may not redistribute, republish, resell, sublicense or make the levels available to others, in whole or in part, including through a group, channel, website, bot or signal service; share an API key; scrape or systematically extract data other than through the interfaces we provide; use the Service to build a competing product; circumvent limits, entitlement checks or security; or use it unlawfully. An AI agent you connect acts on your behalf and under your responsibility.
6. Subscription, free trial and renewal
Paid plans are sold through Link, the merchant-of-record service operated by Stripe, which collects the price, applies VAT, issues receipts and invoices and handles refunds under its own terms. Price, taxes and billing period are shown before you pay; a launch price stays while your subscription continues. A new customer may get one free trial, which requires a payment card: unless you cancel before it ends, the subscription starts and the card is charged. One trial per customer. The subscription renews automatically until you cancel, which you can do at any time from the application or your Link account, with effect at the end of the period already paid. Price changes apply from the next renewal, with at least 30 days' notice. Except as provided in section 7 or by law, a period already begun is not refunded.
7. Right of withdrawal
If you are a consumer resident in the European Union, you may withdraw from a paid plan within 14 days of taking it out, without giving a reason (Articles 52 and following of the Italian Consumer Code). Because a plan starts immediately, before checkout we ask you to expressly request that it do so. If you withdraw within the 14 days, you pay only for the service supplied until then, in proportion to the price, and the rest is refunded (Article 57(3)). Nothing is due during a free trial. To withdraw, use "Withdraw from contract here" on the Plans page of the application, available for the whole period, or write to legal@livegexlevels.com. We confirm by e-mail and refund within 14 days, to the payment method you used.
8. Data and availability
Levels and reference prices may be delayed, incomplete or wrong, and are not executable prices. There is no service level agreement: the Service may be slow or unavailable, including because of failures of third parties or attacks, and no credit or compensation is owed for that. Never let LiveGexLevels be the only way you can see or manage a position.
9. No warranty
The Service is provided as is and as available. To the extent the law allows, and without prejudice to consumers' mandatory rights, we give no warranty that the levels are accurate, complete or suitable for your purposes, or that the market will react to them. A level is a model output, not a forecast and not a promise. Illustrations on our website use fabricated values and are not a record of real trades or results.
10. Limitation of liability
Nothing in these Terms limits liability that the law does not allow to be limited, including for wilful misconduct or gross negligence (Article 1229 of the Italian Civil Code), for death or personal injury, or under mandatory consumer law. Subject to that: we are not liable for trading or investment losses, lost profits or missed opportunities arising from your decisions, whether or not the Service showed something relevant; we are not liable for losses caused by the Service being unavailable, delayed or degraded, including an alert that did not arrive; indirect losses are excluded; and our total liability in any 12-month period is limited to the greater of the fees you paid us in the preceding 12 months and EUR 100.
11. Intellectual property and trademarks
The Service, its software, levels, methods, texts and the name LiveGexLevels belong to AGORHUB or its licensors. Nothing is granted beyond the licence in section 5. S&P 500® and S&P® are trademarks of Standard & Poor's Financial Services LLC, mentioned only to describe the market the Service refers to; LiveGexLevels is not affiliated with, sponsored, endorsed or licensed by S&P Dow Jones Indices.
12. Suspension, termination and changes
You may stop using the Service and close your account at any time. We may suspend or terminate access, with notice where reasonably possible, if you materially breach these Terms, if the law requires it, or if your use creates a security or legal risk; a breach of section 5 is always material. We may change these Terms; if a change is material and to your detriment we notify you at least 30 days before it takes effect, and you may terminate free of charge before that date.
13. Law, courts and complaints
These Terms are governed by Italian law. If you are a consumer you keep the protection of the mandatory rules of your country of habitual residence, and disputes may be brought before the courts where you live (Article 66-bis of the Consumer Code). Otherwise the courts of our registered office have exclusive jurisdiction. Please write to legal@livegexlevels.com first; a consumer may also use an alternative dispute resolution body under the Consumer Code. The EU Online Dispute Resolution platform was discontinued on 20 July 2025.
14. Specific approval (non-consumers)
If you accept these Terms for purposes relating to your trade, business or profession, you specifically approve, under Articles 1341 and 1342 of the Italian Civil Code, sections 2 (nature of the Service), 3 (your confirmations, no reliance, no fiduciary relationship), 5 (licence limits and prohibition of redistribution), 6 (automatic renewal and absence of refunds), 8 (no service level agreement), 9 (exclusion of warranties), 10 (limitation of liability), 12 (suspension, termination and unilateral changes) and 13 (governing law and exclusive jurisdiction). If you are a consumer this section does not apply to you.
15. General
If a provision is invalid, the rest remains in force. Not enforcing a right is not a waiver. You may not assign this agreement; we may assign it to a company that acquires our business, without affecting your rights. These Terms, with the Risk Disclosure, the Privacy Policy and the Cookie Policy, are the whole agreement about the Service. They are published in English, Italian and Spanish; the English text prevails, save where mandatory consumer law provides otherwise.
